Remember our series on the consumer law amendment? This amendment has just been published in the Czech Official Journal, which means it becomes effective on Three Kings Day, 6 January 2023. During the legislative process, the provision governing the use of distance communication by financial institutions has been substantially revised.
As a quick reminder, the use of these means of communication, including e-mail or telephone, will only be allowed if the consumer does not explicitly reject them. In the case of automatic calling or fax machines (😊), the amendment goes a step further and requires the consumer's explicit consent. At first it was not entirely apparent what kind of communication these restrictions covered, although the implemented directive is quite clear. Now the act is clear too. This restriction on distance communication applies only to unsolicited commercial communications. In other cases, for example in regular communication with customers, financial institutions remain free to use apps, e-mail and phones to the same extent as before.
